BidLore — Terms of Use
These terms set out the rules for using the mobile game BidLore ("the game"). They are available free of charge before you download the game. Please read them before you play.
1. Who provides the game
The game is provided by, and your contract is with:
- Dominik Trojanowski Vertias
- sole proprietorship (jednoosobowa działalność gospodarcza) entered in the Polish Central Register and Information on Economic Activity (CEIDG); entrepreneur: Dominik Trojanowski
- country: Poland
- business address: given on the page Publisher and contact
- e-mail: kontakt.vertias@gmail.com
In these terms "we" means the provider named above and "you" means the person using the game. A "consumer" is an individual who uses the game for purposes outside his or her trade, business or profession.
2. What the game is
- BidLore is a single-player game for Android, distributed on Google Play. You play a dealer of antiques and second-hand objects: you inspect objects, set your own limit, bid against computer-controlled rivals at auctions, and then sell what you bought.
- The game is free, shows ads and has no purchases (section 5).
- The game has no account and no server of ours. Your progress is stored only on your device (section 9).
- The game works without an internet connection. The connection is used by Google's advertising software built into the game (section 10). Without a connection the game runs normally and fetches no new ads.
- Google Play's own terms also apply to downloading and installing the game. That is an agreement between you and Google, not part of these terms.
3. The contract: how it is made and what it costs
- These terms are available free of charge at vertias.pages.dev/bidlore/en/terms/, including before you download the game. You can save or print them from your browser.
- The contract for using the game (a contract for the supply of digital content) is made when you install the game and start it for the first time.
- Making the contract and using the game cost nothing. We charge no fees.
- The contract has no fixed term. You can end it at any time, without giving a reason and at no cost (section 13).
4. Licence
- We give you a personal, non-exclusive, non-transferable licence to install the game on devices you control and to play it for your own private, non-commercial use.
- The licence lasts as long as the contract lasts.
- The game is licensed to you, not sold. All rights not given to you here stay with us or with our licensors.
5. Free, with ads, no purchases
- The game is free of charge.
- The game shows ads delivered by Google AdMob. Ads are the game's only source of revenue.
- The game has no purchases: no shop, no in-app purchases, no subscriptions and no paid currency.
- The game shows only one kind of ad: a full-screen ad at the transition after the summary of a completed run — at most one per run and not more often than once every 8 minutes. There are no ads in the tutorial, during an auction, or when the game starts, resumes or closes. Showing ads more often requires a new version of these terms (section 19).
- Ads never change your results, your Intel, your in-game cash or the randomness of the game. Watching or skipping an ad gives you nothing and takes nothing away in the game.
- If no ad is available, or you are offline, the game continues normally.
- Where the law requires consent to the processing of data for advertising, Google's consent form asks for it. Refusing does not block the game. What data the advertising software collects, and how to change your choice, is explained in the Privacy Policy.
- The content of ads comes from advertisers and is delivered by Google. We do not create it and do not check individual ads in advance. We ask Google to limit ad content to the "G" category (content suitable for general audiences); which ads are shown is decided by Google.
- If you tap an ad, you leave the game and go to a third party's app or website. Their terms and privacy rules apply there.
- Using a data connection may cost you money depending on your mobile plan. That cost is between you and your operator.
6. In-game cash is play money
- The cash, objects, reputation, licences and everything else you gain in the game are virtual and exist only inside the game.
- In-game cash cannot be bought for real money, exchanged for money, goods or services, transferred to another person, or paid out.
- The game involves no real money: you cannot stake, win or withdraw money or anything of monetary value.
- Auctions, prices, objects and rivals in the game are part of a game. They are not valuation advice, investment advice or an offer to buy or sell real objects.
7. Technical requirements
- A device with Android 9 or newer and a 64-bit (ARM64) processor.
- Free storage space on the device for the game; the current download size is shown on Google Play.
- The game runs in portrait orientation.
- No internet connection is needed to play. One is needed to download the game and its updates, for ads, and to open the links in Settings.
8. Rules of use
When using the game you must not:
- copy, sell, rent or redistribute the game or parts of it, or distribute modified versions of it;
- decompile or reverse engineer the game, except where mandatory law gives you that right;
- remove or hide copyright notices;
- generate artificial ad views or clicks;
- send us unlawful content in feedback and messages (section 16).
These terms provide for no contractual penalties, and we have no technical means of blocking the game on your device. We may pursue infringements of our copyright as the law provides.
Changing your own save file on your own device may break your game. A save that was modified outside the game is not covered by section 11.
9. Your progress is stored on your device
- Your save exists only on your device. We do not have a copy.
- If you uninstall the game, clear its data, or change or reset your device, your progress may be lost and we cannot restore it.
- Android's own backup feature may keep a copy in your Google account, and restore it on reinstall, if you have backup switched on. This is controlled by you in the Android settings, not by us.
10. Google's software in the game, and risks
- Together with the game, software that is not part of the game's content is installed on your device: Google's advertising software (Google Mobile Ads) and Google's consent tool (UMP). It is used to fetch and show ads, to ask for consent and to remember your choice on the device; among other things it uses the Android advertising ID. Details are in the Privacy Policy, sections 3, 5 and 13.
- Using the game involves the risks typical of an app with ads: an ad may lead to a third party's app or website whose content we do not control; the advertising software sends data to Google even if you refuse personalised ads; data traffic may cost money; in certain situations the save file on the device can be read by another app or a connected computer (Privacy Policy, section 3).
- You can reduce these risks: play without an internet connection, change your consent choice in the game's Settings, reset or delete the advertising ID in the Android settings, and keep your device's system up to date.
11. Conformity of the game and updates
This section describes the rights that the law on digital content gives a consumer. It applies to the extent that this law covers the game; it takes nothing away from those rights and adds nothing to them.
- The game must conform to the contract: it must match the description in sections 2 and 7 and on the game's Google Play page, and be fit for ordinary play.
- We are liable for a lack of conformity that existed when the game was supplied and became apparent within two years of that moment. If it became apparent within one year of supply, it is presumed to have existed from the start. If the law of the country where you live gives you longer periods, the longer periods apply.
- If the game does not conform to the contract, you can ask us to bring it into conformity — free of charge and within a reasonable time. In practice this means a fix in an update of the game.
- If bringing the game into conformity is impossible, would cost us a disproportionate amount, or does not happen within a reasonable time, you can withdraw from the contract. The game is free, so there is no price to reduce or refund. This does not exclude claims for damages as the law provides.
- We supply the updates needed to keep the game in conformity, security updates included, through Google Play for as long as you can reasonably expect for a free game of this kind. We tell you about them in the update description on Google Play. We do not undertake to add new content.
- If you do not install, within a reasonable time, an update that we told you about together with the consequences of not installing it, we are not liable for a lack of conformity that results solely from that missing update.
- An update may also change or add content, for the reasons named in section 19. Such an update is free, is described on Google Play, and reaches your device according to your update settings on Google Play. If such a change makes your use of the game significantly worse, you can end the contract (section 13) and make a complaint (section 12).
- We may stop offering the game on Google Play. This does not take away your rights under this section.
12. Complaints
- If the game does not work as described, or you have another complaint, write to kontakt.vertias@gmail.com or by post to the address given on the page Publisher and contact.
- A description of the problem, your device model, your Android version and the game version shown in Settings will help us. Giving this information is not a condition for dealing with your complaint.
- We reply to a consumer's complaint within 14 days of receiving it. If we do not reply within that time, we are deemed to have accepted the complaint.
- We send the reply by e-mail to the address you wrote from, and by letter if you complained by post and gave no e-mail address.
- Making a complaint costs nothing.
- Questions and reports that are not complaints are handled as described on the Support page.
13. Withdrawal and ending use
- You can end the contract at any time by uninstalling the game. You do not need to tell us and it costs nothing.
- If you are a consumer, you can also withdraw from the contract within 14 days of making it, without giving a reason and at no cost. It is enough to send us a clear statement before that period ends, for example by e-mail to kontakt.vertias@gmail.com.
- You may use this model, but you do not have to: "To: Dominik Trojanowski Vertias, postal address given on the page Publisher and contact, e-mail kontakt.vertias@gmail.com. I hereby give notice that I withdraw from the contract for the supply of digital content — the game BidLore. Date the contract was made: … Name of consumer: … Address of consumer: … Date: … Signature of consumer (only if this form is sent on paper)."
- We confirm receipt of a statement sent by e-mail without delay, by e-mail.
- After withdrawal the contract is treated as never made and you should uninstall the game. You paid us nothing, so there is nothing to refund.
- Sections 6, 14, 15 and 18 continue to apply after the contract ends, as far as they are relevant.
14. Our liability
- We are liable to you as the law provides.
- If you are a consumer, nothing in these terms excludes or limits our liability or the rights the law gives you, including your rights where the game does not conform to the contract.
- Ads are delivered by Google. We do not control whether an ad is available at a given moment or which ad is shown. If you see an ad that you believe is inappropriate, tell us at the address in section 22.
15. Intellectual property
- The game, including its code, texts, graphics, sounds, object designs and characters, is protected by copyright. The rights in the game belong to us or to our licensors.
- The game contains third-party software components under their own licences. The list of those components and the texts of their licences are in the game itself: Settings > LICENCES. They open without an internet connection.
- Google, Google Play, AdMob and Android are names belonging to their owners. Using them here does not mean those owners endorse the game.
16. Feedback and messages you send
- The game lets you prepare an idea or a problem report and hand it over through the Android share sheet. You choose the app and the recipient; the game sends nothing by itself.
- If you send feedback to us, we may use it to improve the game without any payment to you. Do not send content that is unlawful or that you have no right to share.
17. Out-of-court dispute resolution
- If you are a consumer and disagree with our reply to your complaint, you can use out-of-court ways of resolving consumer disputes. Taking part is voluntary for both sides.
- We have not committed in advance to use out-of-court dispute resolution, and the law does not oblige us to. If we do not accept your complaint, our reply will say whether we agree to such a procedure.
- In Poland, information about these procedures and a register of the bodies that run them is published by the Office of Competition and Consumer Protection (UOKiK): polubowne.uokik.gov.pl.
- A list of consumer dispute resolution bodies in the countries of the European Union and in Iceland, Liechtenstein and Norway is published by the European Commission: consumer-redress.ec.europa.eu/dispute-resolution-bodies.
- In a dispute with a trader from another country, free help is given by the European Consumer Centres Network (the countries of the European Union, Norway and Iceland): eccnet.eu.
18. Governing law and courts
- These terms and the contract are governed by Polish law. If you are a consumer and live in another country of the European Economic Area, the choice of Polish law does not deprive you of the protection given to you by those rules of the country where you live that cannot be set aside by agreement.
- These terms contain no arbitration clause. If you are a consumer, you can bring a case against us before a court in Poland or before the court for the place where you live, and we can bring a case against you only before the court for the place where you live.
- If any part of these terms turns out to be invalid, the rest remains in force.
- If the language versions of these terms differ and you are a consumer, you can rely on the version that is most favourable to you among the Polish version, the English version and the version in the language of your country, if we have published one.
19. Changes to these terms
- We may change these terms for important reasons: a change in the law, a change in how the game works (for example new or removed functions, a change in the advertising software), security reasons, or to correct errors or unclear wording.
- The current version, with its number and effective date, is available at vertias.pages.dev/bidlore/en/terms/, and the Polish version at vertias.pages.dev/bidlore/regulamin/. In the game, under Settings, there is a "TERMS" link that opens the terms in the browser; opening it needs an internet connection. When the game is set to a language other than Polish, the link opens the English version.
- This is the first version of these terms; there are no earlier versions.
- An ordinary update of the game (section 11) is not a change to these terms.
- We publish a new version of the terms at the address above, with its number and effective date, before that date. If a change is to your disadvantage, we publish it early enough for you to read it and end the contract before it takes effect.
- A change required by law or by security reasons may take effect sooner if the circumstances require it; we then say why.
- The game itself shows no notice of a change to the terms. If the law requires that you be told of a change in another way than by publication at the address above, the change binds you only after you have been told in that way.
- A change to these terms does not take away rights you acquired before it took effect. If you do not accept a change, you can end the contract at any time by uninstalling the game, at no cost.
20. Age
- The game is not directed at children.
- If you are a minor, use the game with the agreement of your parent or guardian.
21. Privacy
How the game handles data, including the data collected by Google's advertising software and your consent choices, is described in the Privacy Policy.
